1. Introductory provisions
These Terms form an agreement between Moje srdce s.r.o., Company ID 10688099, registered office Oblouková 848/25, 101 00 Prague 10, registered with the Municipal Court in Prague (the “Operator”), and each user of the application. By using the Application, the User concludes an agreement with the Operator and accepts these Terms.
2. Definitions
The “Application” means the mojesrdce.cz mobile and web application providing general medical information and access to specialist consultations. “User” means a natural person aged 15 or over. “Specialist” means a physician who is a member of the Czech Medical Chamber, works with the Operator under contract and is bound by confidentiality. “Core Features”, “Full Care”, “Advisory Service” and “Price” have the meanings below.
3. Concluding the agreement
The agreement is concluded through registration. The Operator may begin providing services immediately and may refuse registration, particularly where a person previously materially breached the agreement.
4. User account
Users provide their name and email address and may upload medical reports for automated processing within the Application. Information must be accurate and kept current. Access credentials must remain confidential, and the User is responsible for activity under the account. The Operator may restrict access for breach of these Terms. Users may request account closure through the Application.
5. Acceptable use
The Application may be used only in accordance with these Terms by people aged 15 or over. Users must not disrupt the service, send spam, engage in unfair competition, breach Czech law, circumvent security, modify content or obtain an unauthorised advantage.
6. Services
Core Features allow Users to record health information, medicines, procedures, blood pressure, heart rate and LDL cholesterol and view general educational information free of charge. Full Care also includes the Advisory Service: specialist-reviewed data entry, personalised recommendations, chat, phone or video advice, and symptom questionnaires reviewed by a Specialist. The Application is not a medical device and does not perform these medical-service functions without specialist oversight.
By using Full Care, the User also enters into a service relationship with the Specialist. Advice depends on the completeness and accuracy of information supplied by the User. The Operator verifies that Specialists meet requirements for independent cardiology practice.
7. Payment
Full Care costs USD 14.40 per month. Prices shown at ordering are final and include VAT and applicable fees. Payment is made in Czech crowns by card through Stripe. Access begins after payment and lasts one month unless renewed; Core Features remain available. Immediate access may affect the statutory withdrawal right for digital services. Refunds, where due, are generally returned by the original payment method.
8. Intellectual property
The Application, software, design, databases, texts and other protected content remain the property of the Operator or relevant licensors. Users receive only a personal, non-exclusive and non-transferable right to use the service as intended.
9. Availability and liability
The Operator may update, suspend or discontinue functions and does not guarantee uninterrupted availability. General information does not replace individual medical advice or emergency services. Liability is governed by mandatory Czech law and the limits set out in the Czech terms.
10. Personal data
Personal-data processing is described in the Privacy Policy, which forms part of these Terms.
11. Changes and termination
The Operator may amend these Terms and will make the current version available. Users who do not accept a change may stop using the service and request closure of their account.
12. Governing law and contact
